What is art licensing?
Art licensing is how brands and manufacturers use my artwork on their products — legally, and with my permission — without ever owning the artwork itself.
Here's how it works. I keep full ownership and copyright of my designs at all times. Through a licence, I grant a company the right to use a specific design, on a specific product, in a specific place, for a set period of time. In return, I'm paid — either a flat fee, ongoing royalties, or royalties with an advance. When the agreement ends, the right to use that design returns to me.
Everything is set out in a simple written agreement so both sides are clear on exactly what's included.
A few terms you might come across:
Licence — permission to use a design on a product, promotion, or service. Not a sale — I keep ownership.
Licensor — me, the artist and owner of the artwork.
Licensee — you, the company using the design under agreed terms.
Agreement (or contract) — the written terms we both sign, setting out what's licensed, where, for how long, and for what payment.
A licence can be exclusive or non-exclusive, which I explain below.
How licensing works with me
I license my artwork — I never sell it. I retain full copyright and ownership of every design and painting at all times.
Non-exclusive licence
The design can be licensed to more than one company at the same time, including on the same type of product. This is a flexible, lower-cost option and a great way to bring one of my existing designs to your range.
Exclusive licence
You become the only company permitted to use that design within an agreed scope — for example, on a specific product category (such as fabric, or bedding), in a specific territory, for an agreed period of time. Outside that scope, and once the term ends, the design remains free for me to license elsewhere. Exclusivity is arranged design-by-design and priced accordingly.
I don't offer buyouts of any kind. Copyright and ownership always remain with me.
Copyright
As the designer, I retain all copyright and ownership of the artwork and all derivative works at all times. All artwork is the sole property of Kirsten Katz and is held under copyright.
The images, artwork, and contents of this website may not be copied, collected, or used for personal or professional gain without the written permission from Kirsten Katz. All images of artwork, sold or otherwise, are retained by Kirsten Katz.
Who actually owns the painting?
I retain all rights to all artwork I create. This includes the rights to the image of sold & commissioned original paintings. I retain the right to make reproductions of any and all artwork I create.
The Collector or buyer may not reproduce the artwork in any way without written permission.
When you purchase an original painting, you own that physical artwork — but copyright always remains with me. The rights to reproduce, license, or make prints of the artwork are never included in a sale and are not available for purchase. This protects the value of your original and the integrity of my work.
Moral rights
As the creator of the artwork, I hold moral rights under Australian copyright law. These remain with me at all times and are separate from any licence. They include the right to be credited as the artist, the right not to have work falsely attributed to another person, and the right to the integrity of my work — meaning it may not be altered or used in a way that would harm my reputation. Attribution as the designer is expected on licensed work unless otherwise agreed in writing.
